Welcome to 86, a platform operated by Carrot Software Inc. (“Carrot”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of the 86 mobile and web applications and related services (“Services”).

 

By using our Services, you agree to be bound by these Terms. If you do not agree, do not access or use the platform.

 

 

1. Intended Use and Eligibility

 

86 is designed primarily for business users in the food service industry, including service providers, suppliers, and professionals seeking to promote, connect, or transact with other businesses. Use of the app constitutes acknowledgment that your purpose is primarily commercial or professional.

 

While the app may be publicly accessible, Carrot assumes that all content creation and event use is business-oriented. You must be legally authorized to represent your business, sole proprietorship, or professional activity when creating content.

 

 

2. Account Access

    •    Unregistered Users may access limited public content.

    •    Registered Users may view and interact with content.

    •    Paid Users may publish content, manage events, and communicate with others.

 

You must provide accurate account information and keep your login credentials secure. You are responsible for any activity conducted under your account.

 

 

3. Business Use and Representations

 

By using the platform as a content creator, you represent that:

    •    You are acting on behalf of a business or as a professional.

    •    You have the authority to use the platform for business purposes.

    •    You will not misrepresent your identity, affiliations, or offerings.

 

 

4. Subscriptions and Billing

    •    Paid accounts enable content and event creation.

    •    A free trial is available with full access, after which you are automatically billed.

    •    Payments are processed via RevenueCat and governed by applicable app store terms.

 

You are responsible for managing your subscription, including cancellation before the trial ends to avoid charges.

 

 

5. User-Generated Content

 

Paid users may publish content, including event descriptions, images, and promotional materials. You:

    •    Retain ownership of your content.

    •    Grant us a non-exclusive, royalty-free license to use, reproduce, and display your content within the platform.

 

You are responsible for ensuring your content is accurate, professional, and does not infringe on third-party rights.

 

 

6. Interactions and Messaging

 

Users may communicate with each other via in-app messaging. You agree to use this feature respectfully and lawfully. Carrot reserves the right to monitor and remove abusive, spammy, or inappropriate communications.

 

 

7. Content Monitoring and Removal

 

We reserve the right to review, moderate, or remove any user-generated content or account that violates these Terms, is deemed inappropriate, or may harm other users or the platform’s integrity. Content decisions are at the sole discretion of Carrot administrators.

 

 

8. Third-Party Services

 

We use:

    •    Google Analytics for usage tracking

    •    RevenueCat for billing

 

By using our Services, you agree to the data processing terms of these third-party providers. We select vendors that align with Canadian privacy standards.

 

 

9. Service Availability

 

While we aim for consistent service, downtime may occur, particularly during scheduled maintenance. No uptime guarantees are made.

 

 

10. Intellectual Property

 

All platform content, branding, and infrastructure—excluding user-generated content—is the intellectual property of Carrot Software Inc. and may not be used without our permission.

 

 

11. Limitation of Liability

 

We provide the Services “as is” with no guarantees of uninterrupted access or performance. To the fullest extent permitted by law, Carrot is not liable for:

    •    Business losses

    •    Missed opportunities

    •    Indirect, incidental, or consequential damages

 

 

12. Account Termination

 

We may suspend or terminate your access at any time, especially for:

    •    Misuse of the platform

    •    Abuse of other users

    •    Violations of law or these Terms

 

 

13. Governing Law

 

These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. All disputes shall be resolved in the courts of Ontario.

 

 

14. Changes to Terms

 

We may update these Terms periodically. We will notify you of significant changes via the platform or email. Continued use after changes indicates your acceptance.
